Notice of Postponement of November 4, 2021 hearing
The hearing scheduled for 7:00 p.m., Thursday, November 4, 2021 involving PECO’s proposed development and operation of a natural gas regulator station at 2090 Sproul Road has been postponed and will not held on the scheduled date. By Order dated October 26, 2021 (copy attached), the Commonwealth Court of Pennsylvania has ordered that the November 4, 2021 remand hearing before the Marple Township Zoning Hearing Board be stayed pending disposition of the Petition for Permission to Appeal filed by PECO. PECO asks the Commonwealth Court to review the Delaware County Court of Common Pleas’ order which remanded the case to the Zoning Board for an additional hearing to allow Marple Township to supplement the record and introduce evidence.
IN THE COMMONWEALTH COURT OF PENNSYLVANIA PECO Energy Company, : Appellant : : v. : No. 1155 C.D. 2021 : Marple Township Zoning Hearing : Board, Township of Marple and : Julia Baker : PER CURIAM ORDER NOW, October 26, 2021, upon consideration of PECO Energy Company’s (Petitioner/Appellant) Application for Stay of the Remand Hearing Pursuant to the Delaware County Court of Common Pleas’ August 27, 2021 Order Pending PECO’s Interlocutory Appeal (Application for Stay), wherein Petitioner/Appellant requests that the November 4, 2021 remand hearing before the Marple Township Zoning Hearing Board (Board) be stayed pending disposition of its Petition for Permission to Appeal (Petition), which Petition asks this Court to review the trial court’s order remanding this case to the Board for an additional hearing to allow Marple Township to supplement the record and introduce evidence, the Application for Stay is GRANTED. Proceedings before the trial court and the Board in this matter, including the November 4, 2021 remand hearing, are hereby STAYED pending disposition of Petitioner’s/Appellant’s Petition and further order of this Court. Given our disposition of this matter, Petitioner’s/Appellant’s Application to Expedite the Consideration of its Petition for Permission for Interlocutory Appeal is DISMISSED as moot. Upon the filing of an Answer to the Petition for Permission to Appeal, the Court will promptly dispose of the Petition. Order Exit 10/26/2
