Public Hearing – Zoning Marple Township CASE NUMBER 2024-13 IS POSTPONED UNTIL WEDNESDAY, DECEMBER 18, 2024 

A public hearing will be held in the I. Newton Kerber Meeting Room of the Municipal Building, 227 South Sproul Road, Broomall, Pennsylvania on Wednesday, November 20, 2024,  at 7:00 p.m. for the purpose of holding a public hearing on the following appeals before the Zoning Hearing Board of Marple Township: 2024-13. County of Delaware (i.) to appeal the determination of the Code Enforcement Officer’s denial of a permit pursuant to Article XVII, §300-136(D)(1) of the Marple Township Zoning Code, as amended, and 53 P.S.§10909.1 of the Municipalities Planning Code; (ii.) to appeal the determination of the Code Enforcement Officer’s denial of a permit based on the conclusion that the uses of the subject property have been abandoned; (iii.) to determine the merits of a substantive challenge to the validity of the rezoning of the Property pursuant to 53 P.S. §10909.1(a)(1) of the Municipalities Planning Code; (iv.) to determine the merits of a substantive challenge to the validity of Article VII §114-50 of the Marple Township Zoning Code, as amended, which the Applicant claims requires a use permit from the Board of Commissioners without specifying a method of appeal; (v.) for a special exception under Article XV, §300-124 of the Marple Township Zoning Code, as amended, which the Applicant claims is to convert from one non-conforming use of the buildings to another non-conforming use; and (vi.) for a variance from Article VIII, Section §300-55 of the Marple Township Zoning Code, as amended, relating to Open Space Zoning Districts, which the Applicant claims is for the use of the existing buildings for the purpose for which they were used and constructed. The Property is located adjacent to Sproul Road, Marple Township, Delaware County and is identified by Parcel Numbers 25-00-04498-03 and 25-00-04498-04 and is currently zoned OS Open Space. The owners of the property wish to use two of the existing buildings on the property for County administrative offices. This property is the former DonGuanella property located Sproul Road across from St. Peter and Paul Cemetery.
